Terms & Conditions
1. Acceptance
By downloading, installing or using COBAL you agree to these terms. If you do not agree, do not download, install or use it. You must be old enough to enter into a binding contract in your country.
2. Licence
Subject to these terms, and for paid content subject to an active membership, you are granted a personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use COBAL on computers you own or control, for your own private and non-commercial use. COBAL is licensed, not sold, and no ownership of it passes to you. Access to paid content and to further downloads lasts for as long as your membership is active.
3. Restrictions
You may not:
- copy, distribute, share, publish, sell, rent, lend, sublicense or otherwise make COBAL available to any other person, in whole or in part;
- upload COBAL to any website, server, file host, repository, cloud service or other online platform;
- share your membership, account or downloads with anyone else, or allow anyone else to use them;
- reverse engineer, decompile, disassemble, decrypt or otherwise attempt to derive the source code, calibration data, parameters or internal design of COBAL, except to the extent that this restriction cannot lawfully be excluded;
- modify, adapt, translate or create derivative works based on COBAL, or use any part of it as the basis for another product;
- remove, disable, bypass or interfere with any licensing, signing, verification or protection mechanism;
- remove or alter any copyright, credit or ownership notice;
- use COBAL or any part of it within a commercial product or paid service, or in anything distributed to third parties.
4. Your own settings
COBAL ships pre-calibrated and needs no configuration. You are free to change the settings the COBAL panel exposes, and to discuss or describe the values you use. This permission covers your own choices only: it does not allow you to distribute COBAL's files, including its configuration and calibration files.
5. Ownership
COBAL, including its software, calibration data, documentation, name and logo, is the exclusive property of Thomas Brauer and is protected by copyright and other applicable laws. All rights not expressly granted in these terms are reserved.
6. Memberships and payment
COBAL is distributed through Patreon. Membership, billing, renewal and cancellation are handled by Patreon and are subject to Patreon's own terms and policies.
By joining and downloading, you ask for immediate access to digital content and accept that any statutory right to cancel is lost once that access has been given, to the extent the law allows. Payments are otherwise non-refundable. If your licence is terminated for breach of these terms, any remaining membership period is forfeited.
You are responsible for keeping your own copies of what you download. We do not provide a backup or archive service.
7. Third-party software
COBAL requires Assetto Corsa, Content Manager and Custom Shaders Patch. These are not supplied, owned or maintained by us, and obtaining and licensing them is your responsibility. All third-party names, trademarks and content remain the property of their respective owners and are referred to here only to describe compatibility.
8. Development and availability
COBAL is under active development. Supported circuits, cars, features and requirements may be added, changed or withdrawn between releases, and no particular content or release schedule is guaranteed.
9. No warranty
COBAL is provided as is and as available, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that COBAL will be uninterrupted or error free, nor that it will remain compatible with any particular version of Assetto Corsa, Content Manager or Custom Shaders Patch, with other mods, or with your hardware. Problems caused by incorrect installation, by other mods, or by updates to third-party software are not defects in COBAL.
10. Limitation of liability
To the fullest extent permitted by law, Thomas Brauer shall not be liable for any indirect, incidental, special or consequential loss, nor for any loss of data, profits or goodwill, arising out of or in connection with COBAL. Total aggregate liability for any claim shall not exceed the amount you paid for COBAL in the twelve months before the claim arose. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.
11. Indemnity
You agree to indemnify and hold Thomas Brauer harmless against any claim, loss or expense arising from your breach of these terms or your misuse of COBAL.
12. Termination
This licence terminates automatically and without notice if you breach these terms. On termination you must stop using COBAL and delete all copies in your possession, and no refund is due.
13. Changes to these terms
These terms may be updated from time to time. The version published on this page is the current one, and continued use of COBAL after an update constitutes acceptance of it.
14. General and governing law
These terms are governed by the laws of [COUNTRY], and the courts of [COUNTRY] shall have exclusive jurisdiction over any dispute. Nothing here affects mandatory consumer protection rights you have in your country of residence. If any provision is found unenforceable, the remaining provisions continue in full force, and failure to enforce a provision is not a waiver of it. These terms, together with the Patreon terms applicable to your membership, form the entire agreement between you and Thomas Brauer regarding COBAL.
