Terms & Conditions
1. Acceptance
By downloading, installing or using COBAL you agree to these terms. If you do not agree, do not download, install or use it. You must be old enough to enter into a binding contract in your country.
2. Licence
Subject to these terms, you are granted a personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use COBAL on computers you own or control, for your own private and non-commercial use. COBAL is licensed, not sold, and no ownership of it passes to you. You may continue to use versions legitimately obtained during your membership after that membership ends, subject to these terms. Access to further paid downloads and membership benefits requires an active membership in the relevant tier.
You may make and restore personal backup copies, including in a private cloud account you control. Keep those copies private: this permission does not allow you to share the copies, access to them or download links with other people, or to redistribute COBAL.
3. Restrictions
You may not:
- copy, distribute, share, publish, sell, rent, lend, sublicense or otherwise make COBAL available to any other person, in whole or in part;
- upload COBAL to any website, server, file host, repository, cloud service or other online platform, except for the private backups permitted in section 2;
- share your membership, account or downloads with anyone else, or allow anyone else to use them;
- reverse engineer, decompile, disassemble, decrypt or otherwise attempt to derive the source code, calibration data, parameters or internal design of COBAL, except to the extent that this restriction cannot lawfully be excluded;
- modify, adapt, translate or create derivative works based on COBAL, or use any part of it as the basis for another product;
- remove, disable, bypass or interfere with any licensing, signing, verification or protection mechanism;
- remove or alter any copyright, credit or ownership notice;
- use COBAL or any part of it within a commercial product or paid service, or in anything distributed to third parties.
4. Your own settings
COBAL ships pre-calibrated and needs no configuration. You are free to change the settings the COBAL panel exposes, and to discuss or describe the values you use. This permission covers your own choices only: it does not allow you to distribute COBAL's files, including its configuration and calibration files.
5. Ownership
COBAL, including its software, calibration data, documentation, name and logo, is the exclusive property of Thomas Brauer and is protected by copyright and other applicable laws. All rights not expressly granted in these terms are reserved.
6. Memberships and payment
COBAL is distributed through Patreon. Membership, billing, renewal and cancellation are handled through Patreon and are also subject to Patreon's terms and policies. The price, billing period and content included in each membership are shown on Patreon before purchase.
Cancellation, refund and withdrawal rights are governed by Patreon's applicable policies and by mandatory law. Where the law permits a right of withdrawal for digital content to end when access begins, that right ends only if the legally required consent and acknowledgement have been obtained. Nothing in these terms removes a refund or other remedy that the law does not allow to be waived.
You are responsible for keeping your own copies of what you download, using the personal backups permitted in section 2. We do not provide a backup or archive service.
7. Third-party software
COBAL requires Assetto Corsa, Content Manager and Custom Shaders Patch. These are not supplied, owned or maintained by us, and obtaining and licensing them is your responsibility. All third-party names, trademarks and content remain the property of their respective owners and are referred to here only to describe compatibility.
8. Development and availability
Current supported circuits are Barcelona GP and Spa-Francorchamps (Kunos, 24 pits), for offline dry races with 11 supported Kunos GT3 cars and six RSS GT-M cars at both circuits. RSS cars are installed separately and are not included with COBAL. See the supported-content FAQ and the README included with your release for coverage and requirements. Earlier versions may support fewer cars or circuits.
COBAL is under active development. Supported circuits, cars, features and requirements may be added, changed or withdrawn between releases, and no particular content or release schedule is guaranteed.
COBAL is intended for users worldwide where access through Patreon and use of the software are permitted by applicable law. Availability in a particular country or language is not guaranteed.
9. No warranty
COBAL is provided as is and as available, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that COBAL will be uninterrupted or error free, nor that it will remain compatible with any particular version of Assetto Corsa, Content Manager or Custom Shaders Patch, with other mods, or with your hardware. Problems caused by incorrect installation, by other mods, or by updates to third-party software are not defects in COBAL.
10. Limitation of liability
To the fullest extent permitted by law, Thomas Brauer shall not be liable for any indirect, incidental, special or consequential loss, nor for any loss of data, profits or goodwill, arising out of or in connection with COBAL. Total aggregate liability for any claim shall not exceed the amount you paid for COBAL in the twelve months before the claim arose. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.
11. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold Thomas Brauer harmless against third-party claims, losses or expenses arising directly from your unlawful misuse of COBAL or your material breach of these terms. This does not apply to losses caused by Thomas Brauer or where such an obligation cannot lawfully be imposed.
12. Termination
This licence terminates automatically and without notice if you breach these terms. On termination you must stop using COBAL and delete all copies in your possession, and no refund is due.
13. Changes to these terms
These terms may be updated from time to time. The version published on this page is the current one. Updates apply from the stated revision date and do not retroactively remove rights already acquired. Where applicable law requires notice or express consent for a material change, those requirements continue to apply.
14. Worldwide application and general terms
These terms are intended to apply worldwide. The governing law and the courts competent to hear a dispute are determined by the applicable rules on governing law and jurisdiction. If you use COBAL as a consumer, you retain the mandatory protections and access to courts provided by the law of your country of residence. Nothing in these terms requires a consumer to bring a claim outside that country where applicable law provides otherwise.
If any provision is found unenforceable, the remaining provisions continue in full force. A failure to enforce a provision is not a waiver of it. These terms, together with the Patreon terms applicable to your membership, form the agreement between you and Thomas Brauer regarding COBAL.
